New Ruling For EWI (I-601) Waiver Applicants

Individuals who are subject to a 3/10 Year Bar may obtain a waiver that permits them to complete the green card process abroad by filing Form I-601 with extensive supporting documentation that his or her citizen spouse will suffer "extreme hardship" if the green card petition is not granted and the alien is not permitted to rejoin his/her family in the United states. The USCIS (AAO) recently issued a decision outlining the requirements for granting an I-601 waiver application in such cases.

Lawsuit Filed Regarding Citizenship Delays

A class-action lawsuit has been filed by immigrants frustrated by the citizenship processing delays. The immigrants have met all requirements for becoming a citizen, but the processing of their petitions are being delayed by FBI name checks.

I-140s For Labor Certs Approved Before 7/16/07 Must be Received by Friday, 1/11/08

A Department of Labor (DOL) regulation posted on May 17, 2007 established a 180-day validity period for labor certifications. The regulation became effective on July 16, 2007. The rule makes all Labor Certifications approved before July 16, 2007 expire on January 12, 2008. The petitions must be received by close of business day on Friday, January 11, 2008.
